In our experience, many policyholders are unaware that the Florida Statutes provide that an insurer generally pays the attorney’s fees of a policyholder that prevails in a lawsuit. The importance of this fact is that it becomes possible in many cases to offer a contingent fee contract where the attorney agrees to accept the court-awarded attorney’s fees as payments, meaning that under such a circumstance that the client does not pay out-of-pocket for attorney’s fees nor are the fees paid out of the policyholder’s insurance benefits. Because the decision to take a case on a contingency fee arrangement requires an analysis of the merits of the case, Schropp Law Firm cannot make a determination as to whether it will take a case under a contingency fee arrangement without a consultation. However, it is important that prospective clients be aware that it is often possible to retain insurance coverage counsel under such an arrangement.
